Biography
Amanda Zimmerman is a labor and employment attorney who defends employers in a broad range of issues in state and federal courts. Amanda assists clients in a variety of industries – from Fortune 500 companies to local Texas employers – with claims for discrimination, harassment, retaliation and wrongful termination, Fair Labor Standards Act (FLSA) violations, trade secret and non-compete disputes, and claims for defamation and business disparagement. Amanda works closely with clients on every aspect of an employment dispute, including conducting initial investigations, responding to EEOC charges, engaging in discovery, taking depositions, drafting and successfully arguing dispositive motions, mediating cases, negotiating settlement agreements, and trying cases.
Additionally, Amanda provides advice and counsel to clients regarding legal compliance with human resource issues and preparation and review of employee handbooks, employment contracts, and other workplace policies. Amanda also has experience representing media and entertainment clients and has successfully obtained multiple dismissals under the Texas Citizens Participation Act, the Texas anti-SLAPP statute.

Career Highlights
Obtained summary judgment in federal court on behalf of homebuilder client in FLSA litigation. The Court agreed that the plaintiffs were exempt employees pursuant to the FLSA’s administrative exemption. Scott McLaughlin, Marlene Williams, Mallory Beck, and Amanda worked together to secure this result.
Obtained dismissal of multiple FLSA collective action plaintiffs based on res judicata grounds. Amanda, Scott McLaughlin, and Marlene Williams comprised the team that secured this result.
Obtained dismissal pursuant to the Texas Citizens Participation Act of defamation, business disparagement, and tortious interference claims brought against a home healthcare client and its CCO. Amanda and Bob Latham handled this matter through appeal, which resulted in favorable precedent under the CPA.
Secured dismissal of charges brought against a Texas judge by the Texas Commission on Judicial Conduct stemming from the Judge’s use of Facebook to inform the public about proceedings in her court. Amanda joined Chip Babcock, William Powers, and Luke Gilman to achieve this result.
